The Anti-Corruption Court decided to close the case against the former head of an agricultural holding company on charges.
The Supreme Anti-Corruption Court closed the criminal proceedings related to the alleged misappropriation of a $20 million loan from Oschadbank by the agricultural holding Kreativ, involving former chairman Yuri Davydov. The ex-People’s Deputy Stanislav Berezkin's children and others will continue to be tried.
This decision was made on January 19 by the VAKS, reports “Word and deed“.
“The defense counsel's motion to close the criminal proceedings was granted. The criminal proceedings No. 420160000000001254, registered on May 16, 2016, were closed with respect to (Yuriy Davydov) based on paragraph 10 of part 1 of Article 284 of the Criminal Procedure Code of Ukraine.“, the decision states.
As reported by Word and Deed in the Specialized Anti-Corruption Prosecutor’s Office, the prosecutor has already appealed this decision to the VAKS Chamber of Appeal.
As you know, VAKS closed case of Oschadbank due to the expiration of the pre-trial investigation. The SAPS prosecutor appealed this decision. Court of Appeal VAKS complaint satisfied and returned to hear the case again.
Recall that SAP closed two cases against ex-People’s Deputy Berezkin due to his death. According to investigators, ex-People’s Deputy Berezkin in 2013-2014 organized a criminal group, aiming to take $20 million from Oschadbank, granted to the agricultural holding “Creative” as a loan. At that time, the people’s deputy was effectively in control of the company, and his son was a co-founder. Investigators claim that after receiving the loan, secured by an elevator and a fake contract, the funds were promptly transferred to the accounts of the Swiss company CREATIV TRADING SA and the Belizean company Quadra Commodities SA Limited under agreements for the sale of tropical oil products for the specified amount.

In this case, the actual delivery did not occur. Subsequently, 10 million dollars were transferred by Quadra Commodities SA Limited to the Latvian bank ABLV Bank. Afterward, $7.64 million was transferred to the Cypriot offshore Pricewaterhousecoopers Associates Ltd for the purchase by Quadra Commodities SA Limited of 100% of the shares of Barcosta Ventures Limited, which owns 97% of the shares of Chornomorgidrozhelezobeton PJSC. The remaining $2.32 million loan proceeds were sent to Titan LTD, another Belizean company, to a Latvian bank account. According to the investigation, CREATIV TRADING SA, Quadra Commodities SA Limited, and TITAN LTD were controlled by the same group of individuals.
Berezkin himself acknowledged investing in the purchase of the Chernomorgidrozhelezobeton plant during his testimony in the Supreme Court of Belize in 2015. According to law enforcement officers, Berezkin’s son and daughter now own a controlling stake in Chernomorgidrozhelezobeton.
