Deputy regional prosecutor Alexander Khvostov approved the indictment against Tengiz Gigiberia, known in the criminal world as Tengo Potisky.
Convicted for murder, arms trafficking and robbery for the second time they will try to attract under Art. 210.1 of the Criminal Code of the Russian Federation “Occupation of the highest position in the criminal hierarchy.” If convicted, Tengo Potiysky faces up to 15 years in prison.
– In 2021, during the first consideration of the materials of the criminal case, the Lipetsk Regional Court demanded that the charge be specified. Now the prosecutor’s office has fulfilled the demand, the evidence base has been strengthened. The case was again sent to the Lipetsk Regional Court for consideration, Tatyana Tkacheva, Assistant Prosecutor of the Lipetsk Region, told GOROD48.
Being a thief in law has become a criminal offense since April 2019. Now Gigiberia is serving a 17-year sentence in the Yelets “deuce”. At the trial in 2021, Gigiberia did not deny that he had been a thief in law since April 2019, but he contradicted himself, pointing out that he did not show his status in any way: he did not manage the obshchak, did not distribute criminal titles to anyone, did not participate in resolving conflicts between convicts in the Yelets “deuce”. Tengo Potisky claimed to have been the victim of a slander. He, they say, has been sitting in solitary confinement since 2011 and cannot use his privileged position in any way. The defendant then put forward the version that the entire charge against him was the work of the colony employees, who allegedly benefit from a status prisoner, as if with his hands they can get rid of problem convicts.
As a result, the process that began in February 2021 ended unexpectedly – with an acquittal. But the first court of appeal of general jurisdiction overturned the first acquittal in Russia in the case of occupying the highest position in the criminal hierarchy against Tengiz Gigiberia.
