Krasnoyarsk crime boss Konstantin Naibauer, nicknamed Kostya Kansky, will again stand trial.
“The case of Konstantin Naibauer, accused of committing a crime under Article 210.1 of the Criminal Code of the Russian Federation (occupying the highest position in the criminal hierarchy), which was considered by a jury in 2021, after an acquittal overturned in the appellate instance, was again submitted to the Krasnoyarsk Regional Court. Date of the hearing has not yet been appointed,” the press service of the court said.
As reported, on September 16, 2021, the Krasnoyarsk Regional Court acquitted the accused under the article on the highest position in the Neibauer criminal hierarchy.
Prior to that, on September 13, 2021, he was acquitted by a jury. They unanimously disagreed with the arguments of the investigation and admitted that the defendant’s guilt had not been proven.
In January 2022, on the proposal of the regional prosecutor Roman Tyutyunik, the Judicial Collegium for Criminal Cases of the Fifth Court of Appeal of General Jurisdiction in Novosibirsk overturned Neibauer’s acquittal.
The Court of Appeal agreed with the arguments of the submission that during the trial the defense committed violations of the law, which allegedly affected the objectivity of the jurors in reaching a verdict.
In October 2019, Naibauer was detained in his own house by the Russian Guard. The criminal case was initiated under Article 210.1 of the Criminal Code of the Russian Federation (occupation of the highest position in the criminal hierarchy). The sanction of the article provides for up to 15 years in prison. According to the police, for a long time he was an authority in the criminal community of Krasnoyarsk.
The case went to court in 2020. The case was heard by a jury at the request of the defendant.
