VAKS extended the investigation into the case of the ex-head of the State Fiscal Service Nasirov and Bakhmatyuk

The Supreme Anti-Corruption Court extended until February 17 the term for investigating criminal proceedings on suspicion of former head of the State Fiscal Service Roman Nasirov of receiving unlawful benefits from oligarch Oleg Bakhmatyuk because of his adviser.

“On Thursday, December 8, a judge of the Supreme Anti-Corruption Court extended the pre-trial investigation in criminal proceedings on suspicion of three people until February 17, 2023. Recall that in this criminal proceeding, suspicions were raised: to the former chairman of the State Fiscal Service (part 4 of article 368 of the Criminal Code of Ukraine); his adviser (part 5, article 27, part 4, article 368 of the Criminal Code of Ukraine); to the owner of the agricultural holding (part 4 of article 369 of the Criminal Code of Ukraine),” informs the court.
Earlier, the High Anti-Corruption Court arrested Nasirov with an alternative of more than half a billion hryvnia.
Recall that NABU and SAP reported about the suspicion to the former head of the State Fiscal Service Roman Nasirov of receiving more than UAH 722 million of unlawful benefits. The oligarch Oleg Bakhmatyuk was also informed about the suspicion of providing this benefit, but in absentia.
The investigation established that the chairman of the State Fiscal Service (2015-2016) received an unlawful benefit of $5.5 million for ensuring the reimbursement of more than UAH 540 million to the companies of the agricultural holding in August 2015 and over 21 million euros for the reimbursement of almost 2.7 billion VAT during February August 2016 d. “Service fee”, which, on average, amounted to about 20% of the amount of VAT refunded, Nasirov received on the account of a foreign company controlled by him, as well as a company controlled by his father-in-law and adviser, through another foreign company – “layer”, attracted by the adviser of the ex – an official. The sender of funds, as established by NABU and SAPO, was a non-resident company controlled by the owner of the agricultural holding Bakhmatyuk.
At the same time, part of the unlawful benefit was formed directly from the funds of the budgetary VAT refund and converted into foreign currency. NABU and SAPO have evidence that the chairman of the State Fiscal Service prioritized payments for VAT refunds to the companies of the agricultural holding, not including information about the amounts declared for budget reimbursement by other business entities (including utilities) that were entitled to it. This, in turn, led to lawsuits by such companies and their recovery from the state budget, in addition to the declared amounts of budgetary compensation, at least UAH 2 million in fines.
