The controversial bill on urban development reform was approved by the Rada, as per NERUKHOMI.
On Tuesday, December 13, the Verkhovna Rada of Ukraine voted in favor of bill No. 5655 for reforming the urban planning industry, initiated by Olena Shulyak, the head of the Servant of the People faction.
228 deputies supported the document, surpassing the required 223 votes.
Notably, the European Solidarity and Batkivshchyna factions did not support it. Yaroslav Zheleznyak from Golos was the sole supporter.
The bill faced strong opposition from various quarters including architects, the Ministry of Culture, the NAPC, the Association of Cities of Ukraine, the All-Ukrainian Association of UTC, the Anti-Corruption NGO “Chestno”, the NGO “Together Against Corruption”, and local authorities of Lviv, Chernihiv, Chortkiv, and Rivne.
Among the many comments, it was observed that the draft law involves transferring the functions of the state and local self-government to business entities, placing certain businesses in a position of privilege over others. It was also pointed out that the bill favors large developers and is rife with corruption risks.

Today, the Verkhovna Rada (Verkhovna Rada) may pass bill No. 5655 in the second reading, which is being promoted by the head of the Servant of the People party, Olena Shulyak, even among the chairpersons of the G7 countries in Ukraine. If VR gets 226 votes, the post-war reconstruction of Ukraine and the creation of new cities will simply be impossible, because there will be no legal basis for real planning and control over construction. This is because construction will be controlled not by the state or local government, but by the developers themselves. Western partners will not provide any financial support to Ukraine for such a systemic corrupt deal.
It is evident that Olena Shulyak is promoting scandalous law No. 5655 in the interest of major developers, as similar standards were advocated six years ago by the Confederation of Builders of Ukraine (KBU). Dmitry Isaenko, the vice-president of KBU, who is now a member of the ”Opposition Platform for Life” and the Secretary of the Verkhovna Rada Committee on State Power, Local Self-Government, Regional Development and Urban Planning, is playing a role in promoting this law. Natalya Kozlovskaya, the Deputy Minister and a long-time associate of Isaenko, is overseeing the lobbying of No. 5655 in the Ministry of Regional Development. In addition, BP may appoint Elena Shulyak as the head of the relevant committee, giving large developers and HLE a significant influence over urban planning, state, and regional policy in Ukraine, which is almost akin to the return of fugitive President Viktor Yanukovych to power.
It was revealed from the previous agenda of the parliament and our own sources that the likely approval today in the second reading of bill No. 5655 (known as the “urban planning reform) and the appointment of Elena Shulyak as the chairman of the Verkhovna Rada Committee on State Power, Local Self-Government, Regional Development and Urban Planning KV.
As per the previous agenda of the Verkhovna Rada on December 13, 2022, bill No. 5655 is number 22, and before it, under No. 21, there is a draft resolution of the Council No. 8257 on the election of chairmen, first deputies, deputy chairmen, secretaries, members of committees of the Verkhovna Rada, who are invited to appoint Elena Shulyak head of the committee on the organization of state power, local self-government, regional development and urban planning.
As observed by KV and according to the interlocutors of the publication in parliamentary circles, these two events – the second reading of No. 5655 and the appointment of Shulyak as head of the committee – are closely interconnected. It is intended to show the support of Elena Shulyak, which may help increase the number of votes for the controversial law No. 5655, the fame of which has already gone beyond the borders of Ukraine.
The controversial law No. 5655: Fury and pressure of Shulyak and the vacillation of the “servants of the people”
The Deputy Chairman of the National Union of Architects of Ukraine (NUAU) Anna Kiriy aptly and succinctly wrote about the essence of bill No. 5655 in the column for “Economic Truth” Bill 5655 – urban regulation reform:
- The Ministry of Regional Development creates the Town Planning Chamber, which will control all participants in the construction market except for developers. Olena Shulyak's arguments that “smartphones don't take bribes” are worthless, because these smartphones will be controlled by officials of the Ministry of Regional Development;
- Developers will control themselves through private pocket companies, for which they will have to allocate 3-5 million euros. The state, local governments and communities will lose real influence on compliance with urban planning standards, since they will have exclusively supervisory powers – without tools of influence;
- the efforts to stop illegal construction will become almost impossible, leading to the damage of historical and cultural landmarks and buildings.
An even more careful consideration has been given to bill No. 5655 by Georgy Mogilny, a public expert on urban planning, who identified 14 systemic corruption issues and other elements of the Shulyak initiative that are highly unfavorable for society and the state.
Clearly, our cities and communities will start turning into complete slums right in front of us – due to innovations No. 5655 along with Law No. 2518-IX (Bill No. registration of the “right to air”, which legalizes any illegal developments) pushed through by Elena Shulyak in the interest of major developers this summer.

Before this, a meeting took place in the Office of the President (OP) with Olena Shulyak, Deputy Head of the OP Kyrylo Tymoshenko (responsible for all construction areas), Executive Director of the Association of Ukrainian Cities (AMU) Oleksandr Slobozhan and mayors of large cities.
Slobozhan and the mayors opposed No. 5655, which caused an excessive reaction from Elena Shulyak.
“She shouted that all local governments were corrupt, that she was setting the prosecutor’s office on them, and that she was not a “construction mafia” and had nothing to do with the construction business. Although none of those present blamed her for this, ”said a KV source in parliament following the results of this meeting.
However, on December 8, Shulyak managed, with the assistance of three people's deputies from the OPF connected to the construction industry, and the influential figure of the tender mafia Anton Yatsenko, to gather 15 votes for the adoption of No. 5655 in the second reading. Even though two members of the committee from the Servant of the People — Alina Zagoruiko and Vitaly Bezgin — did not attend the committee after a meeting with the community chairmen the day before, having learned the truth about the real causes and consequences of the adoption of No. 5655 from the mayors.
Moreover, according to a CI source in the Rada, Olena Shulyak deceived President Volodymyr Zelensky by claiming that the NAPC had supposedly given positive feedback on the finalized bill. However, as stated in the NACP's conclusion, which has not yet been taken into account in No. 5655 until the second reading, the corruption risks associated with this bill are unreasonable and irreversible.
It appears that these achievements boosted Elena Shulyak's confidence. Because the day before yesterday, accompanied by Alexander Kubrakov, his deputy Mustafa Nayyem (in his Facebook post yesterday, one can hear singing along to Elena Shulyak’s lobbying theses about “smartphones don’t take bribes”) and Digital Deputy Prime Minister Mikhail Fedorov, the head of the party “Servant met with representatives of the G7 countries' embassies to seek their support for Bill 5655.

It is not yet clear who initiated this meeting. Despite the leader of the Servant of the People's public display of confidence, according to KV, Olena Shulyak did not receive the desired support from the representatives of the G7 in Ukraine.
It appears that information about the widespread corruption aspect of bill No. 5655 has already reached the embassies in Kyiv and perhaps the G7 foreign affairs ministries, which closely observe and monitor the work of Verkhovna Rada and Denys Shmyhal's Cabinet.
According to sources of KV, who are familiar with the united stance of the G7 regarding illegal activities in Ukraine, any corrupt actions by our government will result in a partial or complete halt to Western aid after the war. The overall message from Ukraine's foreign partners is: “No one will fund your corruption.”
However, this clearly does not deter the leader of the Servant of the People party or its supporters. Therefore, yesterday, Vitaly Bezgin, the co-author of bill No. 5655 from the Servant of the People faction, urged the bill's authors and local government representatives in a message on his Facebook page to “sit down at the table and be completely transparent”: “In a calm and factual manner, do it live. There is time, as the bill is still awaiting enactment.”
Vitaly Bezgin, who became a member of parliament with the support of Elena Shulyak and former Prime Minister Alexei Goncharuk (all three worked in the grant-reforming structure of the BRDO), likely still aims to secure the position of deputy chairman of the relevant committee through draft resolution No. 8257 itself.
Because community leaders and mayors are open to communication. Only the author group of bill No. 5655 remains closed. Indeed, even the very cautious mayor of Chortkiv (Ternopil region) Vladimir Shmatko mentioned in a post on his Facebook page regarding the controversial law No. 5655:
- involves a monopoly centralized admission of only its own builders to the market, without local government influence. A limited group of individuals will have exclusive rights: they construct, oversee, and put into operation themselves;
- private regulatory bodies are established, to which all responsibilities in the field of urban planning are transferred with a maximum liability of 2 million euros for all projects. The authority of private regulation will be granted by the monopoly body with no accountability for it;
- control and supervision by local government are eliminated and replaced with monitoring, which only involves oversight of unauthorized construction. The mayors' sole function is to file complaints to the Ministry of Regional Development;
- the central monopoly body (City Planning Chamber under the Ministry of Regional Development, – KV) will have the authority to halt any construction without consequences or accountability;
- the rights of landowners are violated, as there will be no accountability for unauthorized construction. It is intended to be possible to construct on land without registering ownership.
As the mayor of Chertkov, I appeal to the deputies of the Verkhovna Rada not to vote tomorrow and send it for revision! Together with the All-Ukrainian Association of UTCs and the Association of Cities of Ukraine, finalize and vote with the preservation and strengthening of the powers of local self-government,” called on Chortkiv Mayor Volodymyr Shmatko. with the Chairman of the State Inspectorate for Architecture and Urban Planning of Ukraine (GIAG) Semyon Krivonos.
Here it is necessary to recall that the GIAG was created with the active participation of Elena Shulyak, allegedly in order to overcome corruption in the GASI. But it didn't happen as expected. It turned out that one of the vice-chairmen of the GIAG has a very dubious past. And then it became known that back in December 2021, NABU detained a “representative of the Perfect Group” on suspicion of taking a bribe. The same Perfect Group, together with Andriy Vavrish's Saga Development, with the actual consent of the GIAG, demolished the Kievproject building on the street. Perfect Group is a group of development companies that is de facto owned by the Vice President of the Confederation of Builders of Ukraine (KBU) and the Secretary of the Verkhovna Rada Committee on the Organization of State Power, Local Self-Government, Regional Development and Urban Planning Dmytro Isaenko, who was elected from the OPPL for the so-called. “Medvedchuk—Stolar's quota,” as KV sources in the construction market say.
It should be noted that Dmitry Isaenko has a very large, if not decisive historical role in the story of bill No. 5655 and other corrupt malicious initiatives.

Yesterday Elena Shulyak went on the information offensive. She even reacted to Mayor Chertkiv's message by starting it in her Facebook post with a link to her own yesterday's column on Economic Truth, in which she did not refute a single well-reasoned evidence regarding the outright corruption component of bill No. 5655.
The column of the chairman of the Servant of the People party of the same lobbyist nature was published yesterday on the Left Bank. Elena Shulyak continues to produce theses, which have already been refuted even by the former co-author of No. 5655 Anna Bondar (220 district, Podol, Kyiv), who withdrew her signature on the bill. But the head of the ruling party, following the well-known thesis of the German dictator of the 20th century, “the more terrible the lie, the more willing the crowd to believe in it,” continues to substitute the concept and distort reality. This is how the scandalous law No. 5655 is progressing.
“The bill[5655] really poses a threat. For officials who “solve the issue” in the construction industry. For some builders who get it they somehow get building permits that shouldn't be due to violations. For functionaries of specialized associations whose law deprives them of the monopoly on training to improve the skills of members. According to rough estimates, they all earn about 10 billion dollars a year from deals and schemes in the construction industry (KV allocation). Hence the aggressive campaign in the media and social networks against bill 5655. Corrupt officials are afraid of transparency, like vampires are of the light (it seems that the head of the Servant of the People party implies his unwillingness to enter into an open discussion and hiding in the shadows of the beneficiaries5 – KV). Namely, the transparency of urban planning is the main goal of the reform,” wrote the main lobbyist of the bill No. 5655.
“They all earn … about 10 billion dollars a year” is a typical manipulation, because Shulyak presses the bribe-takers from the GIAG and the corrupt property developers against industry public associations, establishing an equal sign between them. For these “about 10 billion dollars a year for everyone,” which Shulyak took from the ceiling, probably in her office on Stary Podil, run precisely between officials and developers. Obviously, the chairman of the Servant of the People party, which is still a co-owner of the development companies Midland Development Ukraine LLC and Creator LLC, knows about this.
Today, these two companies of Elena Shulyak and her old friend Olga Zaremba today they earn by renting out real estate objects they inherited from the Russian billionaire Eduard Shifrin (the Zaporizhstal Group, from which large entrepreneurs with Russian roots Vasily Khmelnitsky and Andrey Ivanov also came).
It is symptomatic that yesterday in an interview with RBC-Ukraine, Elena Shulyak directly pointed to the systemic opponent No. 5655 – the National Union of Architects of Ukraine (NUAU). Like, “for many years, the NSAU has been making money by issuing certificates, and its functionaries have constantly received orders from local budgets for the design of facilities.”

KV has carefully revised the investigation of Our Money (Bigus's project, do not confuse it with the canonical Our Money) since March 6, 2018. The story says that back in 2011, the government of Mykola Azarov decided that builders, engineers and architects should regularly renew their certificates. This certification was given to the Ministry of Regional Development and Construction, which, by the way, had already been renamed the Ministry of Regional Development, Construction and Housing and Public Utilities.
The Ministry of Regional Development, which was then headed by Gennady Temnik, transferred the right to conduct certification of specialized sectoral civil associations: the Guild of Designers in Construction, the Association of Construction Industry Experts, the Guild of Engineers for Technical Supervision of the Construction of Architectural Objects and the National Union of Architects of Ukraine.

Each of the four public associations has identified one private structure, where industry experts confirm their certificates. In particular, in NSAU this happens once every five years. According to journalists, this is a monopoly that needs to be broken so that architects can receive and confirm qualification certificates in specialized universities. For some reason, the journalists of Nashi Dengi do not touch upon other specialized associations in their story. So they are interested in the scandalous law No. 5655 & # 8230;
But the main thing is that here a question arises for the chairman of the ruling party Olena Shulyak: the governments of the monomajority have been leading Ukraine for more than three years, so why neither the Honcharuk government nor the Shmygal government are still have not changed this system yet?
Moreover, Elena Shulyak is in the plot of Our Money four years ago, probably as a representative of BRDO, because she sits next to the then head of this grant structure, Alexei Goncharuk. The plot also includes an employee of BRDO, now a people's deputy from the “Servant of the People” Vitaly Bezgin. And all of them are sitting next to the current president of the KBU, Lev Partskhaladze, at that time the Deputy Minister of the Ministry of Regional Development, who said that he wanted to give the right to certify the specialists of the Ministry of Regional Development in order to establish competition.
In view of the numerous corruption scandals that accompanied Lev Partskhaladze, First Deputy Chairman of the Kyiv Regional State Administration, in 2015-2016, his statements about “establishing competition” and “overcoming corruption” looked and look, at least, not convincing.

By the way, back in 2016, it was Lev Partskhaladze who actively lobbied for the transfer of control over developments to private hands. “The other day we (in the Ministry of Regional Development – KV) hosted an event – like a round table. There were Natalya Kozlovskaya (Director of the Department of State Programs and Housing Development of the Ministry of Regional Development, now Deputy Minister – KV), a representative of the State Architectural and Construction Institute, Vitaly Grusevich, Executive Director of the KBU, and others. Grusevich presented the project of private GACI,” a source in the Ministry of Regional Development told KV at the end of March 2016.
According to the source, the KBU proposed to transfer to private GACI the inspection of objects, registration of declarations and the issuance of town-planning conditions and restrictions (MUO). However, the presentation of the executive director of the KBU Vitaly Grusevich ended in nothing. “Practically all the participants of the event criticized the initiative of the builders for the“ crude ”project – and sent it to be finalized,” the KV source summed up at the time.
So it’s not difficult to understand who today is the real author of the Town Planning Chamber under the Ministry of Regional Development, private companies for checking real estate and registering non-existent objects:
— KBU headed by Lev Partskhaladze and the KBU representative office in Rada represented by the secretary of the profile Committee of the Verkhovna Rada Dmitry Isaenko;
Deputy Minister of the Ministry of Regional Development Natalya Kozlovskaya, who is closely connected with Dmitry Isaenko;
– the head of the Servant of the People party, Elena Shulyak, who, while still in BRDO, was in close contact with the KBU, as well as with Dmitry Isaenko, according to CI sources in the construction market and in parliament.

Sources of KV in the parliament and in the construction market unanimously assert that the key figure in the promotion is the secretary of the profile committee of BP, vice president of the KBU and owner of Perfect Group Dmitry Isaenko.
Recall that from 1999 to 2007 Isaenko worked in high construction positions in the Ministry of Defense – from the deputy head of the Central Specialized Construction Directorate to the director of the Department of Construction and Alienation of Funds. From 2007 to 2015, Dmitry Isaenko worked as Deputy Minister of the Ministry of Regional Development, having sat out Dmitry Yatsuba (was a minister twice), Vasily Kuybida, Viktor Tikhonov, Anatoly Bliznyuk, Gennady Temnik and Vladimir Groysman. Isaenko was fired during the time of Minister Gennady Zubko (“the father of decentralization”) only because a scandal erupted over the allegedly fictitious status of an ATO participant that Isaenko had.
Bihus.Info journalists quite reasonably assume that Dmitry Isaenko and his fellow builders, including those from the Opposition Platform for Life, expect a post-war restoration of Ukraine, when due to reparations from the Russian Federation (or from what remains of it) and Western partners hundreds of billions of dollars will be invested in the restoration of the destroyed infrastructure. And the uncontrolled development of this money should be facilitated by the draft law “On reforming the sphere of urban planning No. 5655.
- Summary of KV.If BP adopts the scandalous law No. 5655 and President Volodymyr Zelensky signs it, this will lead to irreversible internal and external negative consequences:
- Ukrainian cities and communities will begin to turn into solid ghettos;
- Western partners will slow down and freeze aid for the post-war reconstruction of our state;
- dissatisfaction with the actions of the authorities on the part of the society, which is holding back the internal Ukrainian silent consensus “do not touch painful issues to defeat the main enemy – the Russian Federation”, after our unconditional victory will result in actions of disobedience and resistance to the authorities of corrupt officials, executions. Which will in no way give us a positive image in the eyes of the allies and will significantly slow down positive transformations.
Given this, the Verkhovna Rada should remove the scandalous law No. 5655 from consideration and, together with professional communities, develop effective and civilized urban planning standards, at the same time canceling all corrupt and lobbying bills of the chairman of the Servant of the People party, Elena Shulyak, and together for the sake of good and good criminal and anti-people laws from the Minister of Agrarian Policy Nikolai Solsky, the head of the Social Committee of the Verkhovna Rada Galina Tretyakova, the head of the Verkhovna Rada Committee on Financial, Tax and Customs Policy Daniil Getmantsev, etc. publications, Olena Shulyak should step down as chairman of the Servant of the People party so as not to compromise the President in the eyes of the Ukrainian people and the world community.
And it’s even better for Olena Shulyak to give up the mandate of a people’s deputy and leave politics for own development and rental business.
