In Kazakhstan, the decision of the Constitutional Court (CC) on recognizing the law “On the First President of the Republic of Kazakhstan – Elbasy” as invalid has come into force.

“Based on the will of the people of Kazakhstan, expressed at the republican referendum of June 5, 2022, on the exclusion from the Constitution of the Republic of Kazakhstan of paragraph 4 of Article 46 and other norms, recognize that at present the Constitution of the Republic of Kazakhstan lacks legal grounds for preserving the Constitutional Law of the Republic of Kazakhstan “On the First President of the Republic of Kazakhstan – Elbasy” in the current law of the Republic of Kazakhstan, in connection with which it is subject to recognition as invalid”, — stated in the official statement of the COP.
Earlier, on January 5, a group of deputies of the Kazakh parliament appealed to the Constitutional Court of the republic with a request to give an official interpretation of paragraph 4 of Article 62 of the Constitution of Kazakhstan. The parliamentarians also asked for clarification on whether the constitutional Law “On the First President of the Republic of Kazakhstan – Elbasy” is subject to recognition as invalid due to the exclusion of the norms governing his status and powers.
The document on the abolition of the law “On the first president – Elbasy” was adopted for consideration by the lower house of the Kazakh parliament on December 28, 2022.
