Rusanzhyk used to be the deputy head of the Izmail local prosecutor’s office, but in March 2021 he was moved to the prosecutor position in Bolgrad. He received punishment because he did not do his job properly, as reported by the SCCU decision according to 368.media.
Serhiy Kostenko, the head of the regional prosecutor’s office, complained about Rusanzhyk, saying he made two mistakes. In February 2016, he told a man he was suspected of committing a crime, and in March, he sent the accusation to the Izmail city district court.
After a court meeting on 12 May with Rusanzhyk, the court asked him to fix problems in the accusation according to Article 291 of the CCP, but he did not send it back to the court, so the court did not handle the case.
Rusanzhyk also did not do his job properly in handling a criminal case involving a man's suspicion under Article 309 of the Criminal Code. After announcing the suspicion in February 2017, he did not send the case materials to the Izmail City District Court.
The complaint said that Rusanzhyk did not do his job for 7 years in another criminal case, where materials sent by the Rivne local prosecutor’s office to the Izmail inter-district prosecutor’s office in December 2014 were not handled by Rusanzhyk.
During this time, no investigation took place in the case, breaking the requirements of Article 28 of the CCP about conducting investigations in a reasonable time. The case materials were found in the Bolgrad District Prosecutor’s Office.
Rusanzhyk admitted his mistakes and said they were due to a heavy workload.
He remembered being told in late 2018 or 2019 by the head of Izmail prosecutor’s office that there were case materials in his office. He was asked to take the materials to the Bolgrad branch of the Izmail prosecutor’s office for storage. In December 2021, case materials were found in the Bolgrad District Prosecutor’s Office archive while reviewing a request from the Rivne Regional Prosecutor’s Office.
The PSCC decided to bring prosecutor Rusanzhyk to disciplinary responsibility and impose a disciplinary sanction in the form of a reprimand on him.
