Case of Dubnevichi CHPP: the defendant was fined
The Court of Appeal imposed a fine on him due to another failure of the former official of the company that owns one of the combined heat and power plants.
The Court of Appeal of the Supreme Anti-Corruption Court imposed UAH 7,443 in fines on Oleg Pavlyshyn, former financial director of Energia-New Section LLC. He is accused of involvement in the appropriation of state gas by the Novoyavorovskaya and Novorazdelskaya CHPPs, which are owned by People's Deputy Yaroslav Dubnevich and his brother Bogdan.
This decision was made on November 14 by the AP VAKS, reports Word and Deed.
“The reasons for the non-arrival of the accused Oleg Pavlyshyn to participate in the court hearings scheduled on 11/11/2022 and 11/14/22 are recognized as disrespectful. Impose a penalty in the amount of UAH 7443 on the accused Oleg Pavlyshyn. The court proceedings are to be postponed until 13:00 on November 17, 2022,” the decision says.
As you know, the VAKS closed the case on the appropriation of gas from the Dubnevichi CHPP due to the expiration of the investigation period. SAP has appealed this decision.
Recall, according to NABU and SAP, ex-director of Energia LLC Igor Kuchma, head of Energia-New Rozdol LLC Igor Artymko, his deputy Igor Ilkiv, financial director of Energia-New Rozdol Oleg Pavlyshyn and ex-director of NPP LLC Energia-Novoyavorivsk Oleksandr Oleksiuk during 2013-2015 organized a scheme to seize natural gas, owned by NJSC Naftogaz of Ukraine, on an especially large scale, creating an organized criminal group.
According to law enforcement authorities, Novoyavorivska and Novorozdolskaya CHPPs (owned by Energia-Novy Rozdol LLC and NPP Energia-Novoyavorivsk LLC, owned by people’s deputies Dubnevichi) purchased natural gas from NJSC Naftogaz Ukrainy at a preferential price under the guise of using it allegedly for the production of thermal energy for the population, which is a prerequisite for its use, appropriated it by using it for industrial needs, in particular the production of electrical energy with its subsequent sale to SE Energorynok.
In general, during 2013- In 2015, these persons seized natural gas from NJSC Naftogaz of Ukraine in the amount of 308.34 million cubic meters, which caused material damage to NJSC Naftogaz of Ukraine in the amount of more than UAH 1.4 billion. This case was at the stage of a preparatory meeting before closing.
