Naftohaz’s statute changed to appoint Oleksiy Chernyshov
Ministers have changed the legal status of the company to remove a barrier to changing the head of the oil and gas monopoly, the SJD writes.
The Cabinet of Ministers has changed the statute of Naftohaz Ukrayiny so that former Regional Development Minister Oleksiy Chernyshev can head the state-owned company.
The updated version of the NJSC’s charter changed the legal status of the company. Now it is a legal entity that can acquire property and personal non-property rights, obligations and carry out transactions in accordance with the requirements of the legislation and these charters. The previous edition of the oil and gas monopolist’s statute defined it as a legal entity of private law.
The statute of Naftogaz. What were the contradictions?
The thing is that Article 26 of the law on prevention of corruption sets forth the prohibition for ministers to conclude labor contracts with private law legal entities within a year after their resignation, if they had the authority to supervise or prepare decisions regarding the company activity, and, as we know, the government has been acting as the Naftogaz of Ukraine supervisory board for a long time. In addition, the oil and gas monopoly is required to agree changes to individual agreements with the government, according to the Cabinet of Ministers’ decision.
The update of the NJSC’s statute removed legal restrictions on Chernyshev’s appointment.
