Dmytro Firtash's Kharkivgaz lost to Ukrtransgaz in court
The Economic Court of Kharkiv Region satisfied Ukrtransgaz's claim against Kharkivgaz (in case No. 922/4129/19) and decided to recover UAH 932 million from the defendant in favor of the plaintiff, writes Finbalance.
This amount includes UAH 789 million of debt for balancing natural gas volumes (in July-December 2018 and January-February 2019 ); 108 million hryvnia fines; UAH 9.6 million 3% per annum; UAH 25.4 million in inflationary losses.
The court also refused to satisfy the defendant's request for a deferral of debt payment.
Kharkivgaz is part of the RGK (Regional Gas Company) group associated with Dmitry Firtash.
This company was called one of the operators of gas distribution networks, whose seized assets, by court decision, were transferred to management for ARMA, and by decision The Cabinet of Ministers, they should be transferred from ARMA to the Naftogaz group for management. However, NAK has not yet managed to take control of Firtash's regional gas companies, former head of Naftogaz Yuriy Vitrenko has already stated.
Ukrtransgaz is part of the Naftogaz group, ensures the operation of Ukrainian underground gas storage facilities, and also carries out work on the modernization and construction of gas pipelines and facilities on them. Until January 1, 2020, Ukrtransgaz also operated the Ukrainian gas transmission system. However, after unbundling is completed, this function is performed by the GTS Operator.
Earlier, Ukrtransgaz reported that market participants owed it UAH 43.6 billion for negative imbalances in 2016-2019. At the same time, the state-owned company filed 68 lawsuits for UAH 45.4 billion. (including penalties).
We add that on 08/02/2021 the Supreme Court decided to leave the decision of the Eastern Economic Court of Appeal dated 03/10/2021 (in case No. 922/2381/16), which was partially satisfied Naftogaz's lawsuit against Kharkivgaz and it was decided to recover UAH 175 million of debt from the plaintiff (taking into account 3% per annum, inflation losses).
