People who own exclusive houses in the Maetok complex near Kyiv will be kicked out
The legal case against the Maetok cottage complex, which was mentioned by Finbalance, is developing in an interesting way.
To remember, over 37 elite houses and areas of land in the Maetok complex (in the villages of Ivankovichi and Roslavichi near Kyiv) were taken from the mortgage of Ukreximbank because of an illegal auction scheme in the bankruptcy process. The Supreme Court canceled this auction, so all these houses and land areas may be taken back from the current owners, returned to the bankrupt's property and put under the bank's mortgage for selling as part of the bankruptcy process. However, the current owners may have the right to claim compensation for the value of the property from the organizers of this scheme.
The bankruptcy case of Construction Ukrainian Union LLC has been ongoing for more than 10 years, and the state-owned Ukreximbank hasn't received any money throughout this process. This shows issues in the Bankruptcy Procedures Code and the inefficiency of the judicial system in Ukraine and the Ministry of Justice, which hasn't been able to assess the inaction of the liquidator and properly oversee the bankruptcy process.
The claim for the recovery of residential buildings with land areas from 33 defendants has finally reached the Economic Court of the Kyiv Region. However, Ukreximbank shouldn't relax regarding the actions of the company's liquidator, S. Gorbach, who is the plaintiff in the claim. The court noted that the arbitration manager didn't send copies of the claims to the defendants, possibly indicating an attempt by Mr. Gorbach to hide this claim. This may be unsatisfactory for Igor Kitskoy, the beneficiary of Construction Ukrainian Union LLC, who is likely to have claims.
It can be seen from the court ruling dated 11/23/2022 that among these defendants are Odestorg LLC, Listvan LLC, Vitrus LTD LLC, StatusHouse LLC, and others are individuals. On the official website of the “Judicial Power” under case number No. B8/065-12 (911/2359/22), all the personalities, including business representatives, civil servants, and even partners of the beneficiary of LLC “Construction Ukrainian Union” Igor Kitskaya, can be seen.
Unofficial sources reported that at the end of October this year, the court approved a similar claim filed by Gorbach and demanded two land areas in the “Estate” from the current individual owner.
For the 33 defendants mentioned earlier, the possibility of being kicked out of the houses in Maetok is becoming real.
