15 members of the Verkhovna Rada’s profile committee, in the interests of large developers, secondarily supported bill No. 5655 for the second reading
Today, 15 members of the Verkhovna Rada (Verkhovna Rada) Committee on the organization of state power, local self-government, regional development and urban planning for the second time supported bill No. 5655 for adoption in the second reading, which is being lobbied by the chairman of the Servant of the People party Olena Shulyak (in the collage in the center ). Now this bill can be put on the agenda of the Verkhovna Rada on December 13-14. If there are 226 votes in the session hall in support of No. 5655, large developers will start creating pocket FLPs that will control the objects of these developers. The newly created Town Planning Chamber under the Ministry of Regional Development, which will become a new “tender mafia”, will receive super-large powers. The influence of local governments and architects on the adoption of urban planning decisions will be reduced to zero – and cities and communities will begin to be built up anywhere, anywhere and anywhere. A positive vote for Shulyak and the developers took place thanks to the people's deputies from the Opposition Platform for Life and the non-factional Anton Yatsenko, the infamous “godfather of the tender mafia”, writes KV.
The results of the voting of the profile committee, the meeting of which was reported today by KV, were told to the publication by sources in BP. draft law No. 5655, as well as an additional table on the comments of the NAPC, the Association of Ukrainian Cities, the GNEU and the notaries, which the secretariat of the committee wrote at a frantic pace last night and at night.
However, according to parliamentary sources, KV, the second time in adoption of bill No. 5655 in the second reading at a meeting of the committee on the organization of state power, local self-government, regional development and urban planning, 15 people's deputies voted:
Alina Zagoruiko and Vitaly Bezgin (Servant of the People), who last time (that is, for the first time) voted for the adoption of No. 5655 in the second reading, did not come to the committee meeting). It should be noted that Bezgin is a creature of Elena Shulyak, the main author and lobbyist of bill No. 5655. “Maybe he (Bezgin, — KV) began to realize after yesterday’s event with mayors and chairmen of communities that this is really political suicide — Shulyak’s initiative,” said one from the interlocutors of KV.
Recall that yesterday, on December 7, on the basis of the Committee for the Organization of State Power, Local Self-Government, Regional Development and Urban Planning, the dialogue “Parliament and Local Self-Government: Dialogue on the Future” was held. At this meeting, the mayor of Belopolye (Sumy region) Yuriy Zarko publicly thanked the parliamentarians that No. 5655 was withdrawn from consideration, and the mayor of Chortkiv (Ternopil region) Volodymyr Shmatko noted that in No. 5655 it is necessary to refine the powers of local architects, strengthen the powers of local governments . over unauthorized construction and changing the facades of historical buildings, because bill No. 5655 transfers all these powers to the Ministry of Regional Development and private individuals.
“When receiving letters, the heads of the communities told the parliamentarians:“ You don’t need to accept 5655. And the same topic was actively discussed after the public part of the event, ”said a source in parliament.
But, Vitaliy Bezgin and Alina Zagoruiko were quickly replaced by Anton Yatsenko, who used to be a representative in the BYuT and the Party of Regions, and was known as the “godfather of the tender mafia” during the presidencies of Leonid Kuchma, Viktor Yushchenko, and Viktor Yanukovych.
“Yatsenko abstained when No. 5655 was voted on the committee for the first time before the second reading. And now he is screaming that this is “the best law in the world.” It looks like he got his fate, ”an interlocutor in the Rada shared with KV.
Meanwhile, it's clear that a favorable vote for Elena Shulyak and major developers occurred with the help of people's deputies from the Opposition Platform for Life: committee secretary Dmitry Isaenko, former mayor of Zaporozhye Vladimir Kaltsev, and ex-employee of the Odessa State Construction Agency Tatiana Plachkova. All three have their own interests in the construction industry.
The leader of the Servant of the People party also has interests in the construction industry: Elena Shulyak is still a co-owner of Midland Development Ukraine LLC and Creator LLC, which are directly related to the real estate market and the construction industry.
Only Anna Bondar (Servant of the People, District 220, Podol) opposed No. 5655, after earlier removing her signature from the bill and publicly addressing the corruption and anti-urban planning rules of the Servant of the People party's initiative.
“In my opinion, the two main risks (of bill No. 5655) are the introduction of private controllers and the reduction of the role of local governments in urban planning control. The proponents of the private control norm (Olena Shulyak and the de facto committee secretary and vice-president of the Confederation of Builders of Ukraine Dmitry Isaenko) mention the experiences of the USA, Great Britain, France. Yes, these countries have private controllers, but there is also this:
– Residents are involved in the city planning process from an early stage. Resident working groups are actively involved in city hall (London).
— The role of the chief architect of the community is very important. In New York, nothing can be installed or built without the chief architect's approval, even a bench.
– Urban planning documents, including height and building density (not the residents), are included in them (zoning of New York City is a prime example).
– Urban planning councils review not only urban planning documents, but also each construction site.
Competitions are held to enhance architectural quality.
– Public hearings are conducted for urban planning documents and every individual construction project (at the block, district, and city levels) (New York).
– Even the replacement of a door handle cannot happen without approval from the historic area's authority (France).
– Norms for building are more stringent, and traditions have a longer history (for example, Great Britain has kept a land registry since the 12th century).
In such a system with existing safeguards where everything has been thoroughly discussed, agreed upon by residents, specialists, and the mayor’s office beforehand, private structures can take on construction control. Incidentally, in all other European countries, local authorities handle control because it's their traditional practice.
The plan suggested by the bill is different.
In summary, the state's role is being strengthened and more opportunities are being given to construction companies. The rights of architects, designers, local residents, local self-government bodies, and bodies for the protection of cultural heritage are balanced.
Viktor Baloga, a People's Deputy from the For the Future group, who had strong criticism of norms No. 5655, chose not to vote today. The remaining eight committee members did not attend the meeting, which is seen as a form of protest.
KV has repeatedly written about the criminality and corruption of bill No. 5655:
- the Town Planning Chamber under the Ministry of Regional Development, which will have almost limitless powers similar to the Tender Chamber of Anton Yatsenko, will be established;
- major developers will establish pocket FLPs to control their developments;
- the role of local governments in urban planning will be greatly diminished or completely corrupted;
- architects will be largely excluded from urban planning and construction processes;
- developers will be allowed to register non-existent real estate properties, which they will use to legalize any illegal developments through pocket sole proprietorships;
- it includes the registration of real estate properties through notaries, which is not typical for notaries and carries significant corruption risks.

A source in the parliament informed KV that at this meeting all the mayors of the cities opposed No. 5655, and Elena Shulyak had an outburst: “She shouted that all local governments were corrupt, that she was setting the prosecutor's office on them, and that she had nothing to do with the construction business. Although no one in the audience accused her of this.
According to KV, the meeting participants were confident that they had convinced the leadership of the OP and the Servant of the People party to reject bill No. bill.
In fact, the NAPC did not address any of the significant concerns regarding the corruption risks of bill No. 5655. “Although today at the committee, the representative of the NAPC remained silent. It seems like they’ve been influenced as well,” one of the members of the committee who attended the meeting shared with KV.
It is expected that on December 13-14, bill No. 5655 will be put on the agenda of the Verkhovna Rada – for the second reading. Probably, at the same time, an attempt will be made to appoint Elena Shulyak as the head of the committee on the organization of state power, local self-government, regional development and urban planning, which she has been expecting for a long time.
