The Court of Cassation opened proceedings on the complaint of the defender of the convicted former servant of Themis against the guilty verdict.
The Supreme Court will consider a complaint against the verdict by which former judges of the Goloseevsky District Court of Kyiv, Andriy Novak and Oleksandr Bilyk, were sentenced to 7.5 and 7 years in prison, respectively.
This decision was made on December 13 by the Cassation Criminal Court, reports “Word and Deed”.
“To open cassation proceedings on the cassation complaint of the defense counsel based on the verdict of the Supreme Anti-Corruption Court dated February 03, 2022 and the ruling of the Appeals Chamber of the Supreme Anti-Corruption Court dated July 11, 2022,” the decision says.
As you know, the VAKS sentenced the former – Judges Novak and Bilyk to 7.5 and 7 years in prison, respectively. The court deprived Novak of the right to hold the position of a judge for 3 years with the confiscation of all property, and Bilyka – only confiscation.

Let us recall that, according to the prosecution, ex-judge Novak, through the mediation of the former judge of the same court, Bilyk, received an unlawful benefit in the amount of $8,000 for making a decision in a civil case. In addition, during the search, a firearm and ammunition were found on the suspect without a legal permit.
The actions of the judge are qualified under Part 3 of Art. 368 (request to provide and receipt by an official of an unlawful benefit for himself, the commission by such an official, in the interests of the one who provides the unlawful benefit, of actions using the power granted to him and his official position, the subject of which was an unlawful benefit on a large scale, committed by an official holding a responsible regulation) and part 1 of article 263 (carrying firearms, ammunition without a legal permit) of the Criminal Code of Ukraine.
The actions of the intermediary are qualified under part. 4, 5 Art. 27, part 3 of Art. 368 of the Criminal Code of Ukraine (incitement and complicity in the request to provide and in the receipt by an official in a responsible position of an unlawful benefit for himself, the commission by such an official in the interests of the one who provides the unlawful benefit, actions using the power granted to him and his official position, the subject of which was unlawful benefit on a large scale).
