Pechersky District Court of Kyiv fined Verkhovna Rada deputy from Servant of the People Oleksandr Gaidu UAH 3,400 for a conflict while visiting a cafe « Strudel” in Odessa, writes 368.media.
The materials indicate that Gaidou committed actions in the conditions of a real conflict of interest, namely: using the deputy powers granted to him, in accordance with Art. 16 of the Law “On the Status of the People's Deputy of Ukraine”, he addressed the State Emergency Service with a deputy appeal, the Odessa Mayor with a deputy appeal and the State Service for Food Safety and Consumer Protection with a deputy appeal, in which issues of his private interest were raised.
The court proceedings established that on December 24, 2021, in an institution on the street. Fontanskaya road, 57A between Gaidu and an unknown woman on the one hand and cafe workers on the other hand, a conflict arose over the denial of service due to the lack of appropriate COVID-certificates among visitors to the establishment.
After the conflict, Oleksandr Gaydu appealed to the State Emergency Service, the Mayor of Odessa and the State Service of Ukraine for Food Safety and Consumer Protection, who were asked to check the operation of the cafe and, if there were grounds, take response measures, as well as provide information about the entrepreneur who operates in the establishment and he has the relevant permits.
The court found that the information requested in the deputy's appeals was personally required by Hyde, which indicates his private interest.
The private interest of the people's deputy was in conflict with his official authority (right) regarding deputy appeal to state authorities and local governments, their officials, heads of enterprises, institutions and organizations, regardless of ownership and subordination, associations of citizens.
The court found Gaida guilty of committing offense, under Part. 2 Article. 172-7 CUAO. Currently, Alexander Gaidu is challenging the court's decision.
