The document also provides for the introduction of a ban on the conclusion of contracts on surrogate motherhood for those who are not legally married.
Deputies of the State Duma adopted in the first reading a draft law on the introduction of a ban for foreign citizens on the use of the services of surrogate mothers in Russia. It is reported by TASS.
According to the current legislation, a surrogate motherhood agreement can be concluded between a surrogate mother and “potential parents”. At the same time, whether “potential parents” should be spouses or not is not specified in the current version of the law. The authors of the bill propose to ban those who are not legally married from entering into surrogate motherhood contracts.
In addition to the condition that “potential parents” must be married, the bill provides for the introduction of another condition – at least one of the parents must have Russian citizenship.
Thus, if adopted, the bill will deprive citizens of other states of the opportunity to use the services of surrogate motherhood in Russia.
According to the authors of the draft law, at present, Russian legislation lacks a clear and strict list of conditions for potential parents who wish to use the services of surrogate motherhood in Russia. Russian competent authorities are not able to check such parents if they are foreigners (for example, whether they have a criminal record, including for crimes against sexual integrity). The adoption of the amendments, according to deputies, will solve this problem.
