    Roman Fomichev negotiated with the investigation for a period of 2 years in jail.

    Kirovsky District Court of Yaroslavl on May 11 acknowledged the deputy of the regional Duma Roman Fomichevfound guilty under Part 4 of Art. 291.1 (mediation in bribery on an especially large scale) and sentenced to two years’ imprisonment in a strict regime colony. He was also fined 2.9 million rubles. Another criminal case involving bribing an official on a large scale was closed due to Roman Fomichev's cooperation and confession. The deputy was arrested in the courtroom.

    Roman Fomichev was arrested by law enforcement agencies in April 2021. He was charged with mediating in giving a bribe to a former official of the regional government. Eduard Grebenshchikov from December 1, 2017 to January 13, 2018, on behalf of the briber, to help in finalizing a state contract for purchasing 30 apartments in Yaroslavl for orphans. The bribe amount was 1.49 million rubles.

    Fomichev, as a construction businessman, gave a bribe to the deputy director of the department of property and land relations, Mikhail Rysev. Both officials accepted money to approve government contracts for buying apartments for orphans.

    Roman Fomichev struck a deal with the investigation and disclosed the names of officials who accepted bribes, hoping for a reduced punishment. Initially, the deputy was accused of three episodes, two of which are very serious and carry a sentence of over 10 years in prison. However, the deal worked, and during a meeting on May 1, the state prosecutor from the prosecutor’s office of the Yaroslavl region no longer insisted on harsh punishment, canceling two of the three episodes.

The prosecutor’s office finally insisted on convicting Fomichev on one episode for mediation in bribery on an especially large scale and agreed with the proposal of the defense to stop criminal prosecution, release Fomichev from criminal liability for two episodes of bribes committed by him, in view of the fulfillment of the conditions of the pre-trial agreement,

    Prosecutor’s office during the judicial debate requested that Roman Fomichev be sentenced to 3.5 years in prison in a strict regime colony with a fine of 29.9 million rubles. in the framework of a criminal case under Part 4 of Art. 291.1 (mediation in bribery on an especially large scale). During the debate, the defense side asked the court to impose a sentence on Roman Fomichev not related to real deprivation of liberty. According to the decision of the Kirovsky District Court, the time Roman Fomichev was under house arrest from April 4, 2021 to May 10, 2022 will be counted as a term of imprisonment. Two days of being under house arrest will be counted as one day of imprisonment. The terms of the deputy’s detention from April 1 to April 3, 2021 and from May 11, 2022 until the court’s sentence enters into force will be counted towards the term of imprisonment at the rate of “one day of detention for one day of serving a sentence in a strict regime colony.” Also, the deputy was deprived of the right to hold certain positions related to the implementation of the functions of representatives of government and local self-government for two years. The verdict can be appealed to the Yaroslavl Regional Court within 10 days from the date of announcement.
