The Nikulinsky Court of Moscow swiftly considered the application of First Deputy Prosecutor General Anatoly Razinkin. The court fully accepted the control's request to declare insignificant the orders of the Federal Agency for State Property Management regarding the 52 real estate objects managed by FSUE Ateks FSO, turning the objects into Russia's income.
The editorial staff reports that the confiscated properties include 2 buildings at 45 Novoslobodskaya Street, 8 apartments and rooms, 10 non-residential premises, basements on Mira Avenue, buildings in the Throat Dead End in the Tverskoy district of Moscow, and several buildings in Lyubertsy near Moscow. The estimated cadastral price of these properties is at least 1.3 billion rubles.
The Prosecutor General’s Office discovered the “illegal withdrawal from the state ownership” and its transfer to FSUE “Ateks” through corruption involving the former management of the company. This occurred while the Office was supervising investigations into several FSO employees and associated businessmen.
Initially under the Ministry of State Property of the Russian Federation, FSUE Ateks was later transferred to the FSO. Its main task was to create products, carry out work, and provide services in the interests of state security bodies. The FSO itself could not engage in commercial work due to its military nature.
Between 1999 and 2007, the Federal Property Management Agency transferred various properties including residential buildings, administrative and office buildings, a hotel, a hostel, and warehouses to the operational management of the FSO. In 2008, Dmitry Mikhalchenko, the head of the Forum holding, facilitated the appointment of his partner Andrey Kaminov as the manager of the Federal State Unitary Enterprise. According to materials submitted to the FSO, Kaminov initiated the transfer of real estate from the FSO to FSUE Ateks by preparing a report addressed to the acting head of the FSO at the time, Yevgeny Murov. Following its study, the objects were assigned to the Federal State Unitary Enterprise.
According to the lawsuit, the FSO attempted to reclaim the properties due to violations in their use, but Mr. Kaminov obstructed these efforts.
According to the General Prosecutor’s Office, the disputed objects were used for the commercial interests of Mr. Mikhalchenko and persons controlled by him by Mr. Kaminov and his deputy Stanislav Küner. For instance, premises on Novoslobodskaya Street and in the Gorlovy Dead End were rented by Synergy LLC, which is affiliated with the head of the Forum, through an auction organized by Mr. Küner, until the end of 2026. Six other LLCs under the control of Mr. Mikhalchenko's associates were assigned as founders of Synergy.
At the same time, Synergy brought the disputed property into the illegal economic sector and transferred it to XXI Century LLC, United Travel Center LLC, Document Preparation Center LLC, and other companies controlled by Mr. Mikhalchenko for their illegal gain.
Additionally, from 2008 to 2014, Messrs. Kaminov and Kuener signed 23 contracts with the Federal Security Service of the Russian Federation and 28 work contracts with companies controlled by Mr. for supplying products to special forces facilities. According to them, the oligarch’s holding companies received over 33 billion rubles.
Meanwhile, in September 2021, FSUE Ateks was deemed groundless by the decision of the capital arbitration. A competitive proceeding has been initiated against the debtor, and its manager and other management bodies have been completed.
At the same time, the prosecutors found that due to the defendants' malicious behavior, the bankruptcy estate included not the property of the perpetrators of illegal gain and ruin, but the property of the country that was illegally taken as a result of their corruption agreement.
The defendants in the prosecutor’s lawsuit, Mikhalchenko and Kaminov, are currently held in the Lefortovo pre-trial detention center. Along with former employees of the FSO, they are on trial for organizing a criminal group for the fraudulent embezzlement of 1.3 billion rubles and for repair work on the residence of the head of the Russian Federation in Novo-Ogaryovo. Mr. Küner, who reached a pre-trial agreement in the same case, was sentenced to 8 years, which he is serving in colony No. 3 of the Kursk region. Previously, its prisoners produced parts for ZIL vehicles, and at the moment, zucchinis, ducks, and geese are grown in the main.
The defendants haven't decided yet whether to protest the decision of the Nikulinsky district court, which fully satisfied the prosecutor’s statement. At the beginning of the proceedings, they objected to the replacement of Judge Aigul Shaikhutdinova by Elena Kuznetsova due to illness, believing that she could have formed a certain attitude towards the defendants.
Last year, she granted the anti-corruption application of the General Prosecutor’s Office of Russia to Mr. Mikhalchenko and others by confiscating the St. Petersburg deep-water port of Bronka. After his detention, the head of the Forum transferred the asset to the wife of the former head of the FSO, Yevgeny Murov, and retired general of the Federal Security Service Nikolai Negodov in an attempt to save it from seizure.
