In Novosibirsk, employees of the GKU NSO “Center for ensuring measures in the field of civil defense, emergency situations and fire safety of the NSO” dismissed for lack of vaccination are trying to prove the illegality of their dismissal in court.
This story is told by the publication “Precedent“.
Mandatory vaccination for certain categories of citizens was announced in the region. Based on the decision of the sanitary doctor in the center of civil defense and emergency situations, 13 people were suspended from work without pay. “I am not against vaccination, my husband was vaccinated, I have many relatives who have been vaccinated, but everyone has the right to voluntarily make this decision. For example, I have contraindications for this vaccine. I have allergic reactions and the doctor refused to vaccinate me. I showed my supervisor that I had a medical exemption, but I was nevertheless suspended from work without pay. I think this is unfair,” says Svetlana Sidorchuk, one of the center’s employees.
Another dismissed person, Oleg Pogorelov, says that the center’s employees do not at all fall under the list of population groups specified in the decree.
A class action lawsuit was filed by 11 people in the Zheleznodorozhny District Court. The defendant should be the chief sanitary doctor for the region Alexander Shcherbatov.
The interests of the plaintiffs will be represented by a retired prosecutor, Marina Medvedeva. According to her, the sanitary doctor does not have the right to make decisions on mass unaddressed dismissal from work. It can only remove specific workers who have infectious diseases. In this case, it turns out that healthy people are removed from work.
